Terms and Conditions for AI Chatbot Service

Effective Date: 7-01-2025

1. Service Overview

MTech Marketing (“we”, “us”, “our”) provides an AI chatbot service (“Service”) that can be integrated into your website, whether built by us or a third party. The Service is designed to enhance customer engagement and automate responses on your website.

2. Pricing and Payment

Introductory Price:$97 per month (discounted from$197 per month).
Setup Fee: A one-time, non-refundable setup fee of$97 is required before activation.
Usage Fees: In addition to the monthly subscription, a usage fee of$0.0004 (0.04 cents) per message applies. Full usage fees https://mtech.marketing/usage-fees-page
Wallet System: Usage fees are deducted from your account wallet. When your wallet balance reaches zero, it will be automatically recharged to a minimum of$10.
Service Suspension: If your wallet is not successfully recharged or if the monthly subscription payment is not received, the Service will be suspended immediately until payment is made.
Billing: Monthly fees and wallet recharges are billed in advance. Payment is due upon receipt of invoice.
Price Changes: We reserve the right to modify pricing, including usage fees, with 30 days’ notice.

3. Service Activation and Use

The Service will be activated upon receipt of the setup fee and first month’s payment.
You are responsible for providing accurate website information and access as needed for integration.
The Service is provided “as is” and may be subject to updates or changes at our discretion.

4. Customer Responsibilities

You are responsible for the content and legality of any data or information provided to or generated by the chatbot on your website.
You must not use the Service for unlawful, harmful, or abusive purposes.
You are responsible for informing your website users about the presence and function of the chatbot, including any data collection.

5. Data Privacy

We collect and process data in accordance with our Privacy Policy.
By using the Service, you consent to the collection and use of data as described in our Privacy Policy.
You are responsible for ensuring your website’s privacy policy reflects the use of AI chatbot technology and any data collected.

6. Intellectual Property

All intellectual property rights in the Service, including software, content, and branding, remain with MTech Marketing or its licensors.
You are granted a non-exclusive, non-transferable license to use the Service on your website during the subscription period.

7. Limitations and Disclaimers

The Service is provided “as is” without warranties of any kind, express or implied.
We do not guarantee uninterrupted or error-free operation of the Service.
We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.

8. Termination and Cancellation

You may cancel the Service by providing at least 30 days’ written notice prior to your next billing cycle.
No refunds will be issued for setup fees, usage fees, wallet balances, or partial months.
We reserve the right to suspend or terminate the Service for non-payment or violation of these terms.

9. Changes to Terms

We may update these Terms and Conditions at any time. Continued use of the Service constitutes acceptance of the revised terms.
